Terms of Service

Welcome to Mapenzi. These Terms of Service ("Terms") govern your use of the Mapenzi mobile application and related services (collectively, the "Service"). By creating an account or using Mapenzi, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Mapenzi

Mapenzi is a dating application designed to help people discover compatible individuals and build meaningful relationships. The App provides features including profile creation, user discovery, messaging, voice notes, date planning, and premium subscriptions.

2. Eligibility

• You must be at least 18 years old to create an account and use Mapenzi.
• You must be legally capable of entering into a binding agreement.
• You must not have been previously banned from the Service.
• You must not have any convictions related to violent or sexual offenses.

By creating an account, you represent and warrant that you meet all of the above requirements.

3. Account Creation & Security

• You may sign up using your email address, phone number, Apple ID, or Google account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You may only create and maintain one account per person.
• You agree to provide truthful and accurate information on your profile.
• You must not share your account credentials with anyone or allow others to access your account.

4. Account Moderation & Suspension

Mapenzi reserves the right to:

• Investigate: Temporarily suspend your account while we investigate reported violations or suspicious activity.
• Restrict: Limit certain features if your account is flagged for potential violations.
• Terminate: Permanently delete your account if we confirm a violation of these Terms, including but not limited to harassment, fraud, or posting prohibited content.

We will make reasonable efforts to notify you of any action taken on your account, unless doing so would compromise an ongoing investigation or user safety.

5. User Conduct

a) You agree to:

• Treat other users with respect and dignity
• Use the App for its intended purpose: meeting people and building relationships
• Report any abusive, inappropriate, or suspicious behavior
• Keep your profile information accurate and up to date

b) You agree not to:

• Harass, threaten, stalk, or intimidate any user
• Post content that is obscene, pornographic, violent, racist, discriminatory, or otherwise offensive
• Use the App for commercial purposes, advertising, or solicitation
• Impersonate another person or create a fake profile
• Share other users' personal information, photos, or conversations without their explicit consent
• Use automated tools, bots, or scripts to interact with the Service
• Attempt to reverse-engineer, hack, or interfere with the App's infrastructure
• Upload malicious files or content
• Engage in any activity that violates applicable Kenyan law or international law

6. Content You Post

• You retain ownership of all content (photos, text, voice notes) you post on Mapenzi.
• By posting content, you grant Mapenzi a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service.
• This license ends when you delete your content or your account, except where your content has been shared with other users and they have retained it (e.g., in message threads).
• We reserve the right to remove any content that violates these Terms without prior notice.

7. Subscriptions & Payments

a) Premium Features

Mapenzi offers optional premium features through in-app purchases and subscriptions. Pricing and features are clearly displayed within the App before any purchase.

b) Payment Processing

All payments are securely processed by Paystack. By making a purchase, you agree to Paystack's terms of service. Mapenzi does not store your full payment card information.

c) Refund Policy

• Refund requests are evaluated on a case-by-case basis.
• Refunds are generally not provided for subjective dissatisfaction with the Service (e.g., not finding a match).
• Technical issues that prevent you from accessing paid features may qualify for a refund or credit.
• To request a refund, contact support@mapenziapp.com with your transaction details.

8. Account Deletion

• Logging out of the App does not delete your account — your profile remains visible to other users.
• Uninstalling the App does not delete your account or data.
• To permanently remove your profile and data, you must use the Delete Account option in the App settings.
• Account deletion is permanent and cannot be reversed. Your data will be removed within 30 days.

9. Safety with Other Members

Please read our Safety Tips for guidance on staying safe while using the App.

10. Modifications to the Service

We may modify, update, or discontinue any part of the Service at any time to improve the experience, address technical issues, or comply with legal requirements. We will provide reasonable notice for significant changes that affect your use of the Service.

11. Limitation of Liability

Mapenzi is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the maximum extent permitted by law:

• We do not guarantee that the App will be uninterrupted, error-free, or secure at all times.
• We are not responsible for the conduct, actions, or content of any user, on or off the platform.
• We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service.
• Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mapenzi, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Content you post on the platform

13. Applicable Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Any disputes arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of Nairobi, Kenya.

14. Child Safety Policy

• We actively monitor for and remove content that exploits minors.
• Accounts suspected of involving minors are immediately suspended pending investigation.
• We cooperate fully with law enforcement agencies investigating child exploitation.

15. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by email. Your continued use of Mapenzi after changes become effective constitutes your acceptance of the revised Terms.
